Georgia is known as a non-judical&lt;br /&gt;foreclosure state. In plain english, this means that in most cases all your lender has to do to take&lt;br /&gt;your house away is to advertise the foreclosure sale in the legal paper for your county and send&lt;br /&gt;you a letter regarding the foreclosure sale and notice of the sale as submitted to the legal paper&lt;br /&gt;and foreclose on the first tuesday of the month. Generally, foreclosure day is the first tuesday of&lt;br /&gt;each month. To make matters worse, you do not have to physically receive the foreclosure notice. One problem, is the fact that things happen real fast and you have very little time to prepare for such an unpleasant event. However, bankruptcy is one option and it is important that you start the process as soon as possible.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;One option&lt;/strong&gt; and probably the most direct and almost &lt;strong&gt;guaranteed option to Stop &lt;/strong&gt;&lt;br /&gt;&lt;strong&gt;foreclosure is &lt;/strong&gt;to file for bankrupty protection. This option is most likely the least expensive&lt;br /&gt;and most practical. First, you have to qualify for bankruptcy and the best way to find out if you&lt;br /&gt;qualify is to meet with me and let me review your situation. Basically, a chapter 13 bankruptcy&lt;br /&gt;will allow you to take the past due mortgage payments (know as arrears) and pay these arrears&lt;br /&gt;through a chapter 13 plan and then get back on track with your regular monthly payments. For example, lets suppose you are 5 months behind on your mortgage payments and your monthly mortgage payment is $1,000.00 per month and the mortgage company is set to foreclose on May 5, 2009. You file chapter 13 prior to May 5, 2009 and all your past due payments such as the $5,000.00 will be paid through the chapter 13 bankruptcy case and beginning June 1, 2009, you get back on track with your regular monthly mortgage payment.&lt;br /&gt;&lt;br /&gt;Everyone hits a bump in the road and chapter 13 bankruptcy is a way to workout that bump and the opportunity to get back on track. &lt;strong&gt;Filing bankruptcy is a good option&lt;/strong&gt; because in most&lt;br /&gt;cases there are &lt;strong&gt;no guessing games.&lt;/strong&gt; Once you file bankruptcy the foreclosure sale will be&lt;br /&gt;stopped. Also, filing &lt;strong&gt;bankruptcy is economical&lt;/strong&gt; because in most cases only the filing fee and&lt;br /&gt;credit counseling fee is paid up front.
